As part of their daily duties, freight brokers and freight agents perform activities similar to those listed above. However, one of the most significant distinctions, and perhaps the most important point here, is that freight brokers and freight agents work with multiple carrier companies. The FMCSA has authorized freight brokers and freight agents working for freight brokers to contract with ALL registered carriers in the United States.

The FMCSA defines a Property Broker as any third party who arranges for freight to be moved within the United States (Freight Broker). If you want to book or assign loads for more than ONE carrier company, you are no longer an employee or a “bona fide agent” of the carrier company. Instead, you’d be classified as a third-party agency. As a result, as a Property Broker, you must be registered with the FMCSA and have an active US DOT number (Freight Broker). Alternatively, you must be a freight agent working under the license of a registered freight broker. These activities and entities are defined by the MAP-21 law and the 49 CFR, specifically parts 371 and 390.

So, what about those truck dispatching services you’ve been hearing about? How did they come to be? To put it bluntly, those dispatching services violate the 49 CFR regulations. Furthermore, they are not authorized to perform those activities by the FMCSA. Prior to the passage of MAP-21 in 2012, those dispatching services would not have been considered a violation. However, MAP-21 resulted in numerous changes to the transportation industry’s rules and regulations. And here’s one of them.
