Mortgage Foreclosure Defense

Are you unable to make your mortgage payments? Do you feel that your situation is hopeless and that you are powerless against the Banks or other lenders and their attorneys?

There are many powerful defenses to Mortgage Foreclosure that can be used to protect your home. To start a foreclosure action against you in New Jersey, the lender must follow a specific set of legal rules and procedures, and comply with numerous requirements that a lender must specifically comply with in order to foreclose.

In New Jersey, when you purchase a home, you take out a loan, which is called a mortgage. That mortgage is what is known as a secured loan, and the home you purchased is the security for the loan. However, when you do not make your payments (for whatever reason) the Bank or other lender has the right to take back the house through a proceeding known as a mortgage foreclosure. Frequently you will receive multiple notices from the Bank or other Lender’s intent to Foreclose if you do not bring your mortgage payments current.

If the Bank or other Lender does not follow the legal requirements to foreclose on your house, and give you the proper notices, and then serve you with a Summons and Complaint for Foreclosure, then a Foreclosure Defense Attorney can protect your legal rights. But there are also numerous other defenses to mortgage foreclosure, and our law firm knows them all.

No matter what anyone tells you, you should always make mortgage payments, if you are able to. Never stop making mortgage payments, and always consult a mortgage foreclosure defense attorney immediately if you are having problems making your payments.

Although there are many defenses to mortgage foreclosure, one of the most powerful defenses is Chapter 13 Bankruptcy. When a Chapter 13 Bankruptcy is filed for you, the Automatic Stay of the United States Bankruptcy Code goes into effect and (absent rare special circumstances) all lawsuits against you must stop immediately. Unless and until the Bank or other lender obtains permission from the Bankruptcy Court to “lift” the Automatic Stay, the mortgage foreclosure against you must stop. In addition, in a Chapter 13 Bankruptcy, you can “strip off” second and third mortgages.

Even if your home has already been scheduled for Sheriff’s sale, we can stop the sale with a Chapter 13 Bankruptcy.

There is a lot of misinformation posted on the Internet and everyone’s situation is unique, so please contact us for a free initial consultation to see if we can help you.

Estate Planning

New Jersey Estate Planning Attorney

Many people put off making plans for their estates. It’s not pleasant to think about one’s own mortality. However, many people find that once the planning is done they feel much better. It gives them great peace of mind to work out the details and know that their wishes will be respected.

The goals of estate planning include:

  • Making sure the greatest amount of your money and property passes to your designated heirs
  • Paying the minimum amount of taxes and avoiding or minimizing the costs of probate
  • Providing for guardians for minor children
  • Planning for incapacity and end-of life medical decisions

Estate planning is about money, but it’s also about family relationships. A good estate plan can protect a family. A bad estate plan (or having no plan at all) can tear a family apart and cause anger and resentment that lasts for generations.

The Estate Planning lawyers at Leopold Law have a number of tools and documents that they can use to assure that your wishes will be carried out. These include:

  • Wills
  • Trusts
  • Powers of attorney, including medical powers of attorney
  • Health care directives
  • Living wills
  • Family limited partnerships
  • Life insurance

Tax planning and charitable gift planning are also part of the estate planning process. When a family business is involved, that further complicates estate plans.

A will is a document that allows your survivors, your executor, and the courts (if necessary) to determine how you want your assets divided and distributed.

You can write your own will, and handwritten wills can even be valid under New Jersey law. (However, it may take longer to establish the validity of a handwritten will because a judge must verify the signature.)

Some people don’t understand why they should use an estate planning lawyer to create a will. Many fill-in-the-blanks forms are available on the Internet.

However, a recent case reported in the American Bar Association Journal illustrates why do-it-yourself estate planning may not be a good idea.

The article tells the story of Ann Aldrich, a woman who used an “E-Z Legal Form” when she drafted her will in 2004. Her will left her property to her sister, and then to her brother if her sister died before her.

So who ended up with some of her property? Her nieces (daughters of another deceased brother) – who weren’t even mentioned in the will.

The Florida Supreme Court ruled that property acquired by Aldrich after she made out her will was governed by the law of intestacy – the law that determines how property will pass when a person doesn’t have a will.

This happened because the “E-Z” form didn’t have a residuary clause providing for the disposition of property not listed in the document.

Consulting an experienced estate planning lawyer can help you avoid mistakes like this.

If you have questions about estate planning, or if you’re ready to prepare a will or trust, we invite you to contact our Hackensack office for a free initial consultation with one of our experienced New Jersey estate planning attorneys.

Call us today at (201) 345-5907 or send us an e-mail and let us help you with your New Jersey estate planning matter.
